ORDINANCE NO. 2925
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF OXNARD
AMENDING DIVISION 13 OF ARTICLE V OF CHAPTER 16 OF THE OXNARD
CODE RELATING TO ACCESSORY DWELLING UNITS.
WHEREAS, effective January 1, 2017, Government Code §65852.2 was amended regarding
Accessory Dwelling Units and as a result, various provisions of the existing City Code would become
inconsistent with state law, unless the City Code was updated; and
WHEREAS, on December 20, 2016, the Oxnard City Council adopted Ordinance No. 2914,
amending the Oxnard City Code, Chapter 16, Section 16-465, “Second Units,” to be consistent with
Government Code Section 65852.2; and
WHEREAS, the California Department of Housing and Community Development (HCD)
released their 39-page document “Accessory Dwelling Unit Memorandum” and held a webinar of
December 20, 2016 that provided local governments guidance in preparing local zoning code
amendments to comply with Government Code Section 65852.2; and
WHEREAS, on March 27, 2017. HCD conditionally approved the City’s 2013-2021 Housing
Element, which included a direction to “…examine and modify, as appropriate, the recent zoning
amendments passed in 2016”; and
WHEREAS, staff have implemented Ordinance No. 2914 since January 2017 and determined
additional revisions are needed to assist in implementation of the Ordinance while still being in
compliance with Government Code Section 65852.2; and
WHEREAS, it is in the best interest of the public to establish and update standards relating to
ministerial approval of Accessory Dwellings Units in specified zones in the City that are likely to play
an increasingly important role in providing affordable housing; and
WHEREAS, the revisions to this ordinance implements Program 6, Zoning Code Amendments,
of the 2013-2021 Housing Element; and
WHEREAS. Section 15061(b)(3) of Title 14 of the California Code of Regulations exempts the
project from the requirement for the preparation of environmental documents imposed by the State
California Environmental Quality Act; and
WHEREAS, the Planning Commission considered public comments, and voted to recommend
approval of this zone text amendment at its meeting of September 7, 2017.
NOW THEREFORE, the City Council of the City of Oxnard hereby ordains as follows;
